This Online Coaching Service Agreement (“Agreement”) is here to make sure everyone enjoys a safe, respectful, and positive experience as part of our coaching and community. By setting some guidelines, we’re creating a space where members can connect, learn, and grow together with peace of mind. We’re committed to protecting the privacy, safety, and well-being of everyone involved, especially our younger members, with clear expectations for both Forty-Love and the Player (or Guardian, if applicable).

ONLINE COACHING SERVICE AGREEMENT

This Online Coaching Service Agreement (the “Agreement”) is made and entered into as of the date signed below (the “Effective Date”) by and between:

Forty-Love Online Tennis Club (“Forty-Love”), with contact email info@fortylovetennisclub.com.

("Player"): If under 18, the undersigned Parent/Guardian (the “Guardian”) agrees to this contract on behalf of the Player.

Each party to this Agreement is referred to as a “Party” and together as the “Parties.”

1. Scope of Services

Forty-Love agrees to provide online coaching services, including but not limited to virtual lessons, training advice, and performance feedback, as requested by the Player. Services will be delivered through virtual platforms (e.g. video calls, messaging) mutually agreed upon by Forty-Love and the Player.

2. Duration and Termination

Duration: This Agreement is effective as of the Effective Date and will remain in effect until either Party terminates it, following a 3 month period within the program.

Termination: Either Party may terminate this Agreement at any time following a 3 month enrolment (3 monthly payments received) with 30 days’ written notice. If the Agreement is terminated before the end of a paid period, no refund will be provided for any unused portion of the coaching period unless otherwise agreed by Forty-Love.

3. Parental/Guardian Consent (for Minors)

Consent Requirement: If the Player is under 18, the Player’s Guardian must review and sign this Agreement, providing express consent for the Player to receive online coaching services.

Supervision: The Guardian acknowledges responsibility for monitoring the Player’s use of online coaching sessions and agrees to support the Player in adhering to the terms of this Agreement.

4. Fees and Payment Terms

Fees:  The Player (or Guardian, if the Player is a minor) agrees to pay for the coaching services by recurring monthly payments, or the relative conversion rate in the Players currency. Termination will not be permitted until at least 3 recurring payments have been received (3 monthly payments). Thereafter, termination can be requested if the Player no longer wishes to remain within the program.

Payment Schedule: Payment is due monthly and will be processed automatically by Stripe Payments unless the Agreement has been terminated.

Non-Refundable Payments: All payments are non-refundable except in cases of cancellation by Forty-Love or failure to deliver the agreed-upon services.

Late Payments: Payments that are more than 7 days overdue may result in a suspension of services until the balance is paid in full.

5. Responsibilities of the Player and Forty-Love

Forty-Love’s Responsibilities: Forty-Love will deliver agreed-upon remote coaching services to the best of its professional ability, providing guidance, feedback, and support tailored to the Player’s goals.

Player’s Responsibilities: The Player agrees to participate actively in coaching sessions and maintain respectful and professional communication.

Guardian’s Responsibilities (for minors): The Guardian will provide any necessary support to the Player, ensure that online conduct follows safe internet usage practices, and oversee adherence to this Agreement.

6. Confidentiality and Privacy

Confidentiality: Forty-Love agrees to keep all personal and performance information about the Player confidential and will not share it without explicit consent from the Player (or Guardian).

Privacy of Online Sessions: The Player and Forty-Love both agree not to record, share, or publicly post any content from online coaching sessions unless both Parties give consent.

7. Assumption of Risk

The Player (or Guardian) acknowledges that tennis training involves physical activity that may lead to injuries. The Player assumes full responsibility for any physical or mental risks associated with participating in the coaching sessions and agrees that Forty-Love shall not be liable for any injury, accident, or harm arising during or as a result of the sessions.

8. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.

9. Entire Agreement

This Agreement constitutes the entire understanding between the Parties regarding the subject matter herein and supersedes any prior agreements, written or oral, relating to such matters. Any amendments to this Agreement must be made in writing and signed by both Parties.

10. Community Participation on Third-Party App

Community Access: As part of the coaching services, Forty-Love provides access to a community group on a third-party platform, Skool (the “Community”), where Players can interact, share progress, and participate in discussions with other members.

Participation Guidelines: Players (and Guardians, if the Player is a minor) agree to adhere to respectful communication standards within the Community and avoid sharing any offensive, inappropriate, or confidential information. Forty-Love reserves the right to remove any Player from the Community who violates these standards.

Third-Party Privacy and Data Use:  The Community is hosted on Skool, a platform independent of Forty-Love. Forty-Love is not responsible for Skool's privacy practices or any data collected by Skool’s. Players are encouraged to review Skool’s privacy policy and terms of use before joining the Community.

Messaging Services: Within the Community, messaging services are enabled, allowing any user to send messages to other members. Players (or Guardians, if the Player is a minor) may choose to disable the messaging feature to opt out of receiving messages from other users. Requests to disable messaging can be made directly within Skool’s settings or by notifying Forty-Love, who will assist in implementing the opt-out.

Limited Liability: Forty-Love is not liable for any issues or disputes arising from interactions within the Community, nor for any data breaches, loss of information, or other incidents related to the use of Skool.

Opt-Out Option: Participation in the Community is optional. Players may choose to opt out of Community participation or specific features (such as messaging) at any time without affecting their access to other coaching services provided by Forty-Love.

By signing up to the program, the Parties agree to the terms outlined in this Agreement.
